The famous big boy and flamboyant social media celebrity, Ismaila Mustapha, also known as Mompha has filed a fundamental rights enforcement suit against the Economic and Financial Crimes Commission (EFCC) before the Lagos high court Igbosere by his counsel, Gboyega Oyewole SAN. The lawsuit was filed so as to challenge his unlawful detention and violation of his human rights.
On the 18th of October, Mompha was arrested in Abuja. He was alleged of cybercrime and money laundering.
Furthermore, in his application dated November 14, Section 34-36 and Section 46(1) & (2) of the 1999 Constitution, Mompha has appealed to the court to declare that his continuous arrest since October 22 was unlawful. He also emphasised that his detention elapsed since November 4 as ordered by the Lagos Magistrate Court. As part of his demands from the court, he wants the court to restrain the EFCC or anybody acting on its behalf from arresting him concerning the subject matter without following the proper process of law.
The court is yet to respond and also fix a date in order to attend to his case.
